DMFD LIFE
Assumption of Risk, Release of Liability & Waiver Agreement
By booking, participating in, or attending any trip, charter, hunt, or guided experience with DMFD Life (“Company”), you (“Participant”) acknowledge and agree to the following terms:
1. Acknowledgment of Risk
Participant understands that fishing charters, boating activities, and guided hunts (including but not limited to alligator hunting, offshore, nearshore, and inshore fishing) involve inherent risks and dangers, including but not limited to:
- Injury or death from wildlife, including fish, alligators, and other animals
- Slips, falls, or accidents on boats, docks, uneven terrain, or in water
- Use of fishing gear, hooks, knives, firearms, bang sticks, or other equipment
- Weather conditions including heat, sun exposure, lightning, wind, waves, and storms
- Boating risks including capsizing, collision, mechanical failure, or rough seas
- Remote locations with limited or delayed access to emergency medical care
Participant voluntarily assumes all risks, known and unknown, whether caused by negligence or otherwise.
2. Release of Liability
Participant hereby releases, waives, and discharges DMFD Life, its owners, employees, captains, guides, affiliates, partners, and contractors from any and all liability for:
- Personal injury
- Property damage or loss
- Illness, including exposure to environmental or natural conditions
- Death
This release applies to any claims arising from participation in any activity, including those caused by negligence of the Company, to the fullest extent permitted by Florida law.
3. Indemnification
Participant agrees to indemnify and hold harmless DMFD Life from any claims, damages, losses, or expenses (including attorney’s fees) arising from:
- Participant’s actions or behavior
- Violation of laws or regulations
- Damage to equipment or property
- Injury to themselves or others caused by Participant
4. Medical Fitness & Responsibility
Participant confirms they are physically and mentally capable of participating in the selected activity.
Participant agrees:
- To disclose any relevant medical conditions upon request
- To bring necessary medications (including for allergies, motion sickness, etc.)
- That the Company is not responsible for medical care or expenses
In the event of an emergency, Participant authorizes the Company to seek medical treatment on their behalf.
5. Weather, Safety & Captain/Guide Authority
All trips are subject to weather, water conditions, and safety considerations.
The Captain/Guide has full authority to:
- Cancel, reschedule, or modify trips
- End a trip early for safety reasons
- Refuse service to any participant deemed unsafe, impaired, or non-compliant
No refunds are guaranteed due to conditions outside the Company’s control.
6. Equipment Use & Responsibility
Participant agrees to:
- Use all equipment safely and as instructed
- Be responsible for negligent or intentional damage to gear, vessels, vehicles, or property
- Follow all safety instructions at all times
7. Alcohol, Drugs & Conduct
- No illegal drugs are permitted under any circumstances
- Alcohol consumption must be responsible and may be restricted at the Captain/Guide’s discretion
- Participants who are intoxicated, reckless, or disruptive may be removed without refund
8. Licenses, Regulations & Compliance
Participant agrees to comply with all:
- Florida Fish and Wildlife Conservation Commission (FWC) regulations
- Federal, state, and local laws
- Licensing and tagging requirements (especially for hunts such as alligator harvests)
Failure to comply may result in termination of the trip without refund.
9. Photo & Media Release
Participant grants DMFD Life permission to use photos, videos, or other media taken during the experience for marketing, advertising, and promotional purposes without compensation.
10. Booking, Payments & Cancellations
- All bookings are subject to availability and confirmation
- Deposits and payments may be non-refundable unless otherwise stated
- Trips are not guaranteed and may be rescheduled or modified
Additional terms may apply as outlined at the time of booking.
11. Minors
Participants under 18 must be accompanied by a parent or legal guardian.
The parent/guardian agrees to all terms on behalf of the minor and accepts full responsibility for their safety and conduct.
12. Governing Law
This Agreement shall be governed by the laws of the State of Florida.
Any disputes shall be resolved in the appropriate courts located in Florida.
13. Acknowledgment & Agreement
By booking or participating in a DMFD Life experience, Participant acknowledges that they have:
- Read and fully understood this Agreement
- Had the opportunity to ask questions
- Voluntarily agreed to all terms
- Waived certain legal rights, including the right to sue
14. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
15. Counterparts & Electronic Signatures
This Agreement may be executed in counterparts, including electronic or digital formats. Signatures provided electronically (including checkbox acknowledgment, typed name, or digital signature) shall be deemed valid and binding as if originally signed.
16. Binding Agreement
By signing below, or by booking, participating in, or attending any DMFD Life experience, Participant acknowledges that they:
- Have read and fully understand this Agreement
- Understand that they are waiving certain legal rights, including the right to sue
- Voluntarily agree to all terms and conditions
Participant further agrees that this Agreement is binding upon themselves, their heirs, next of kin, executors, and personal representatives.
Agreement to these terms may be completed via online booking, checkbox acknowledgment, or electronic signature and shall be considered legally binding.
